The registration of claim has to provide information about the name, surname and the address of the firm and the seat of the creditor and of the Bankrupt, the legal cause of the claim, ranking of the satisfaction of the claim from the bankrupt´s general estate and the amount of the claim divided to the principal and the interests, and the interests divided according to the legal cause; the registration has to be filled in a special registration form, which has to be dated and signed by creditor. Pre každú zabezpečenú pohľadávku musí byť predložená samostatná prihláška s uvedením zabezpečenej sumy, druhu, poradia, predmetu a právneho dôvodu vzniku zabezpečovacieho práva.

Each secured claim must be lodged separately. Creditors with claims secured with securities also fill in the registration form which has to provide information about the object to which the security is tied, secured sum of claim, type of security and legal cause of security.

Rovnakým spôsobom uplatňujú svoje pohľadávky aj veritelia pohľadávok, ktorých vznik je viazaný na splnenie podmienky, pričom sa uvedie skutočnosť, na základe ktorej má pohľadávka vzniknúť alebo podmienku, od ktorej závisí vznik pohľadávky.

Creditors whose claims depend on the fulfillment of certain conditions register their claims in the same way. They also state in the registration form the condition on which the claim is dependent.

V konkurze uplatňuje svoju pohľadávku prihláškou aj veriteľ, ktorý má pohľadávku voči inej osobe ako dlžníkovi, ak je zabezpečená zabezpečovacím právom vzťahujúcim sa k majetku úpadcu. Pohľadávka sa uplatňuje v mene EUR. K prihláške sa pripájajú listiny preukazujúce údaje uvedené v prihláške. Ak veriteľ nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, v prihláške je povinný uviesť zástupcu na doručovanie písomností, ktorý má bydlisko alebo sídlo na území Slovenskej republiky a ustanovenie zástupcu písomne oznámi správcovi.

Also creditors, who have claim against the third person, however secured by Debtor´s assets, have to lodge their claim in bankruptcy proceedings in question. The claim has to be lodged in currency named as EUR. Documents proving the information provided in the lodgement of claim have to be enclosed to the lodgement of claim. In case the creditor does not have a seat or an address or a branch office in the Slovak Republic a representative with an address or a seat in the Slovak Republic has to be stated and noted to the bankruptcy trustee.

Na prihlášky veriteľov, ktoré nebudú spĺňať zákonom stanovené podmienky a nebudú podpísané, sa v konkurznom konaní neprihliada ako na prihlášku. Ak veriteľ doručí správcovi prihlášku neskôr, na prihlášku sa prihliada, veriteľ však nemôže vykonávať hlasovacie práva a ďalšie práva spojené s prihlásenou pohľadávkou.

Lodgement of claims that will not fulfill the requirements stated by the law or will be not signed or an expert opinion (in case of non-financial claim) will not be attached to the lodgement of claim shall not be considered as lodgement of claims in the bankruptcy proceedings. The lodgement of claim served to the bankruptcy trustee after the basic period of time elapses, shall be considered as the lodgement of claim however the creditor can not  exercise the voting rights and other rights connecting with the lodged claims.

Veriteľ zodpovedá za správnosť údajov uvedených v prihláške podľa § 30 ZKR.

The creditor is responsible for the legitimacy of his registration according to the article 30 of the BRA.

Toto zverejnenie sa vzťahuje k zahraničným veriteľom, ktorých pobyt a sídlo nie je známe z dokumentov dlžníka.

This information is designed for foreign creditors, whose place of residence or seat is not obvious from thebusiness documentation of the debtor.
